July 26, 2013: Arlington Va. Reckless Driving: Rollover: one reckless charge reduced to improper driving, one reckless charge dropped.

July 24, 2013: Arlington Va. Reckless Driving: Misdemeanor for driving 90 in a 55 mph zone dismissed by judge.

June 5, 2013: Arlington Va. Reckless Driving: Misdemeanor reckless driving charge of speeding over 110 mph tried before a judge who reduced the charge to minor infraction of improper driving due to insufficiency of the evidence, and imposed a fine.

April 25, 2013: Fairfax Va. Reckless Driving: Misdemeanor reckless driving reduced to speeding.

Virginia Traffic Court Procedure Overview

Most traffic tickets in Virginia are handled in the general district court.  Be in court on time, or you may be found guilty in your absence. The judge will usually call the officer with the fewest traffic tickets first.  If the officer is the only witness, a traffic case is usually finished in one morning.  In misdemeanor traffic cases, like reckless driving and DUI, a defendant always has the right to a traffic lawyer. This right to a traffic lawyer can be waived by appearing without a traffic lawyer more than once.  A defendant can usually delay a traffic case at least one time by requesting a “continuance.”  If the police officer does not show up the first time, judges in northern Virginia sometimes reschedule the traffic case, especially if it is a serious traffic misdemeanor.  If the officer does not show up a second time, a judge may dismiss the case.  If a case is dismissed, it does not appear on a driving record and no points are assessed. It is helpful to speak with a traffic lawyer familiar with the jurisdiction where you are charged if you have questions about your case.

Is it serious?
Many reckless driving tickets do not result in jail time or a license suspension in Northern Virginia. When faced with such a charge, you can expect to receive unsolicited mail from attorneys warning of dire consequences, including jail. Rather than attempting to scare you, an experienced traffic attorney should be able to give you an honest evaluation of potential outcomes. In many cases, the likely outcome does not involve a trip to jail.
