Personal Injury Law Summary
In Virginia, a personal injury or wrongful death claim begins with an injury that was caused by negligence. In most Virginia personal injury cases, the victim has two years from the date of the injury to settle the claim of file a lawsuit. This is called the statute of limitations. If the injury results in death, then there is a claim for wrongful death and beneficiaries are entitled to damages for their loss according to law.
In Virginia, personal injury lawsuits are almost always filed directly against the negligent person, not directly against an insurance company. However, the initial claim is often filed with an insurance company and many claims are resolved at that level after investigation and negotiation. Sometimes there is more than one insurance company that could be called on to make a payment, especially if the victim is well insured under his or her own policy.
Property damage is separate from the personal injury claim and may be settled separately. Insurance companies usually do not fight property damage claims if liability is clear, unless the victim only has liability coverage.
Many Personal Injury claims I handle settle without the need for a lawsuit. However, each case should be prepared as if it will go to trial. If a lawsuit is required, I and my team are ready.
